1. Competition Organiser

1.1 The ‘What New Product Would You Like GATE to Create?’ competition (the Competition) is organised (the Organiser) by GATE ENTERPRISE spółka z ograniczoną odpowiedzialnością spółka komandytowa of Krakow, ul. Torowa 3H, 30-435 Krakow, Poland, entered into the Register of Entrepreneurs of the National Court Register under entry No. KRS 0000774854, registered under Tax Id. No. (NIP) 679-309-53-16 and Industry Id. No. (REGON) 122953493 (GATE), and INFINITY FUND spółka z ograniczoną odpowiedzialnością spółka komandytowa of Wrocław, ul. Jana Długosza 42-46, 51-162 Wrocław, Poland, entered into the Register of Entrepreneurs of the National Court Register under entry No. KRS 0000562916, registered under Tax Id. No. (NIP) 8952046284 and Industry Id. No. (REGON) 361782081 (GUNFIRE).
1.2 The Competition is held by management boards of GATE and GUNFIRE general partners.
1.3 The Organiser stages the Competition on the Facebook social networking site (Facebook). Any Competition related information shall be shared through the GATE Facebook profile.
1.4 The Competition is not organised, sponsored, administered, related to, or supported by, Facebook, Inc. Facebook, Inc. or entities and websites related to it shall not bear any responsibility in connection with the Competition.
1.5 Competition announcement, Competition Application or posting of the Competition Answer shall not mean that any contract of mandate, service agreement, contract for a specific task or any other similar contract is concluded with a competition participant (the Participant). The Participant shall not perform any activities in the name of, for the benefit of or at the risk of the Organiser, or any paid activities.
1.6 Competition outcome is not randomly triggered, the Competition is not a lottery, raffle, promotional lottery or any other game of chance or a mutual wager within the meaning of the Polish Gambling Act of 19 November 2009.

2. Competition Objective

2.1. The objective of the Competition is to identify (one) best competition answer (the Competition Answer) from among the Competition Answers posted by the Participants on Facebook in the GATE Facebook profile.
2.2. (One) best Competition Answer shall be selected by the Competition Jury (the Jury) from among all the answers to be submitted on Facebook in the GATE Facebook profile. The Jury shall comprise 2 (two) representatives of GATE and 1 (one) representative of GUNFIRE. The Jury has been appointed by the management boards of GATE and GUNFIRE general partners.
2.3. The Organiser shall hold the Competition in compliance with these terms (the Terms).
2.4. Any capitalised terms defined herein shall have the same meaning in the entire Terms, regardless of their grammatical form, unless the Terms provide otherwise.

3. Competition Application

3.1 In order to participate in the Competition, the Participant has to apply to enter the Competition (Competition Application), i.e.:
3.1.1. post the Competition Answer under a competition post on Facebook in the GATE Facebook profile,
3.1.2. accept these Terms and acknowledge personal data protection rules.

4. Competition Rules

4.1. The Competition is open to everybody interested, subject to the technical requirements referred to in Section 7 and the following requirements:
4.1.1. the Participant has to be a natural person with full capacity. Natural persons with limited capacity (in particular minors) may participate in the Competition only with consent of their parents or legal guardians as long as under laws of the country of their permanent residence they may participate in the Competition and accept the Prize, should they become the Winners;
4.1.2. the Participant has to have a legal Facebook account; in particular Facebook must not be used by those who:
 have not reached thirteen years of age,
 are forbidden from using Facebook or payments related to Facebook, given their presence on a blacklist;
 in the past, have had their account blocked due to law infringement or have been convicted for offences stipulated in the Facebook Terms of Service;
4.1.3. the Participant may not:
 use a fictitious Facebook account;
 impersonate anybody else;
 mislead, cheat or pursue illegal objectives;
 interfere with, or impair, Facebook operation;
 post any private or confidential information;
 be a member of governing bodies, employee or another member of the staff of the Organiser or of entities with capital or personal links with the Organiser, an immediate family member of the persons who are members of the governing bodies, employees or other members of the staff of the Organiser, or another person linked with the Organiser in such a way that could affect fairness of competition rules or its outcome. The immediate family members shall be understood as ascendants, descendants, siblings, spouses and adoptees;
 act contrary to rules applicable in the Facebook community or otherwise in breach of decency.
4.2 The Competition Answers have to refer to a new product related to ASG to be potentially manufactured by GATE Enterprise.
4.3 Any intellectual property rights to the Competition Answers as at the moment of their posting and throughout the entire Competition Term have to be held by the Participants who post them.
4.4 The Competition Answers may be submitted from 20 January 2021, 3:00 PM (CET) until 27 January 2021, 1:00 PM (CET) (the Competition Term).
4.5 It is forbidden to post:
4.5.1 more than one Competition Answer submitted by the same Participant,
4.5.2 any Competition Answers created collectively,
4.5.3 any illegal Competition Answers,
4.5.4 any Competition Answers in conflict with the Facebook Terms of Service,
4.5.5 any discriminating, vulgar or drastic Competition Answers,
4.5.6 any Competition Answers in breach of third-party personal rights, in particular offensive ones or infringing privacy.
4.6 The Organiser shall not be responsible for:
4.6.1. failure to post, or removal of, the Competition Answers for technical reasons,
4.6.2. removal of the Competition Answers by Facebook,
4.6.3. actions of any third parties in connection with the organisation of the Competition,
4.6.4. any damage caused by the submission by the Participants of inaccurate, illegible or outdated data, or failure to submit them,
4.6.5. damage or infringements caused by posting of the Competition Answers;
unless such responsibility may not be excluded under applicable laws.
4.7. The Organiser shall promptly remove from the Competition any Competition Answers in breach of these Terms, the Facebook Terms of Service or applicable laws.
4.8. The Participants whose Competition Answers have not been posted or whose Competition Answers have been removed from the Competition, in compliance with these Terms or the Facebook Terms of Service, shall not participate in the Competition. The Organiser shall promptly notify the Participant about the removal of their Competition Answer from the Competition.

5. Competition Outcome

5.1. Competition outcome shall be decided by the Jury.
5.2. The Competition Answers shall be assessed by the Jury in terms of creativeness, innovativeness, positive associations and references to the GATE brand and Airsoft discipline. The Competition Answers have to be compliant with the competition subject matter.
5.3. Any Competition Answers sent after the lapse of the time limit or those failing to satisfy the criteria specified herein shall be rejected.
5.4. An author of the best Competition Answer (the Winner) shall receive a replica of Specna Arms RRA SA-E25 EDGE 2.0™ (the Prize). Other Participants shall not be awarded. The Prize may not be exchanged for money or other awards.
5.5. The Jury’s decision may not be appealed against.
5.6. The competition outcome shall be announced within 2 (two) weeks from the lapse of the Competition Term at the latest. The competition outcome shall be announced via the Organiser’s Facebook profile. The Winner shall be additionally informed about the competition outcome through a Facebook message.
5.7. In order to receive the Prize, the Winner has 48 hours from the moment of announcing the results of the Competition to provide the Organiser, through a Facebook message, with the following data: their name, surname, e-mail address and shipment address. If the Participant fails to provide the aforementioned data within a time limit, this shall mean that the Participant has resigned from the Prize. The Prize shall be shipped to the Winner within 1 (one) week from the announcement of the competition outcome. The Organiser shall not be responsible for a delivery date or course after having shipped the Prize, unless under mandatory rules of law the Organiser is obliged to accept any such responsibility.
5.8. The Organiser and the Jury reserve the right to leave the Competition open.

6. Copyrights

6.1. By submitting the Competition Application, all the Participants grant to the Organiser a non-exclusive licence, free of charge, without any territorial limitations, without any time limitations as of the announcement of the competition outcome, for using their works constituting the Competition Answers, in the following fields of use:
6.1.1. recording and multiplying through any technique whatsoever,
6.1.2. marketing and distributing any copies or other data storage media in any distribution channels,
6.1.3. lending for use, rental or lease of any copies,
6.1.4. entering into a computer’s memory and storing in a computer’s memory,
6.1.5. making them publicly available via IT and ICT networks, including the Internet and mobile telephony – for purposes related to the organisation and promotion of the Competition and of the Organiser, in particular on Facebook and related websites. The Organiser may repost/share the works constituting the Competition Answers without limitations.
6.2. The Winner shall grant a permanent licence, without territorial or time limitations, in the fields of use in accordance with Section 6.1, and undertakes not to revoke the licence.
6.3. The licence shall also encompass an author’s consent to the Organiser developing the Competition Answers, to their distribution and to transferring the right to give further relevant consent.
6.4. By applying to participate in the Competition, the Participant represents and warrants that any intellectual property rights to the Competition Answer are held by the Participant in question and that posting the Competition Answer in the Competition shall in no way breach any third-party rights.
6.5. The licence shall be granted and further consent or authorisations shall be given against payment where all claims against the Organiser for granting of the licence shall be satisfied by awarding the Prize to the Winner.

7. Technical Requirements

7.1. The Competition may be attended by all the Participants who have technical capacity to connect to the Internet, have an active and legal Facebook profile and an active e-mail address.
7.2. The Participant’s ICT system should satisfy minimum technical conditions, i.e. operational official Facebook application installed on a device with technical parameters sufficient to run the Facebook application, in compliance with the manufacturer’s instructions.

8. Processing of Personal Data

8.1. GATE and GUNFIRE shall be controllers of personal data provided by the Participants (the Controllers). 8.2. The personal data to be provided by the Participants shall be processed in order to organise the Competition, publish information about the Winner as well as for archiving purposes and GDPR related accountability purposes.
8.3. The Winner’s personal data may be transferred, among others, to courier companies – to satisfy requirements related to shipping of the Prize – and to other entities that work with the Controllers.
8.4. The personal data shall be processed based on consent and due to the Controllers’ legitimate interests involving:
8.4.1. rendering it possible for the Participants to participate in the Competition,
8.4.2. rendering it possible to archive documentation,
8.4.3. rendering it possible to process complaints.
8.5. Data subjects have the right to:
8.5.1. access the data, and receive a copy thereof,
8.5.2. rectify (correct) their data if they are inaccurate or outdated, and have them erased when the data are not processed in order to satisfy an obligation prescribed by law or as part of public governance,
8.5.3. restrict, or object to, processing,
8.5.4. lodge a complaint with the President of the Personal Data Protection Office (at the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, Poland).
8.6. The personal data are provided on a voluntary basis; nevertheless, their submission is necessary in order to render it possible for the Controllers to organise the Competition, inform the Winner about awarding of the Prize and ship the Prize to the Winner’s address.
8.7. The Controllers shall not process the Participants’ personal data in a manner based exclusively on automated processing, including profiling.

9. Complaints

9.1. The Participants shall lodge any Competition related complaints and objections in writing, to the Organiser’s address: Ten adres pocztowy jest chroniony przed spamowaniem. 9.2. Stakeholders shall be informed about claim resolution by registered post unless the Participants agree to be notified thereof by electronic means.
9.3. Any Competition related questions, comments or objections have to be addressed to the Organiser rather than to Facebook, Inc. or to entities and websites related to it. Any questions, comments or objections related to Facebook rather than to the Competition have to be addressed to Facebook, Inc. or to entities and websites related to it, as the case may be.

10. Final Provisions

10.1. In any issues not governed herein, the Polish law shall apply.
10.2. The Organiser reserves the right to amend the Terms, where any such amendment may not infringe rights already granted to the Participants.
10.3. The Terms shall enter into force as of the date when information about the Competition is posted on Facebook in the GATE profile.
